By accessing or using this website, contacting us, or shopping at our Flushing storefront, you agree to be bound by these terms. If you do not agree, please do not use the site or store.
2. Website content
This website is provided for informational purposes about our Flushing location, departments, hours and wholesale programs. While we make reasonable efforts to keep information accurate, store inventory, pricing and hours can change without notice. Departments and categories listed are illustrative — actual on-floor selection rotates with each incoming pallet.
3. Pricing & availability
All retail pricing is set at the register based on current ticketed prices in-store. Online category pages are not a live catalog and do not list per-item pricing. Liquidation merchandise is generally limited to current floor stock; we cannot reserve items by phone or hold inventory.
4. Sales & returns
Most liquidation and closeout merchandise is sold as-is. Sealed items returned within 7 calendar days with the original receipt and intact packaging may be eligible for store credit or exchange at our discretion. Open-box, demo, glass, special-order and wholesale items are generally final sale unless otherwise marked.
5. Wholesale & B2B transactions
Wholesale and B2B purchases are subject to separate quoted terms, including payment method, lot manifest, pickup or freight schedule and acceptance conditions. Pallet, truckload and container loads are sold as described in the quote and are generally non-returnable after acceptance.
6. Conduct
You agree not to: (a) use the site or store for any unlawful purpose; (b) attempt to access non-public areas of the site, our networks or back-of-house store areas; (c) interfere with the site's normal operation; or (d) misuse contact forms or other channels for spam, fraud or harassment.
7. Intellectual property
The site's content, including text, images, logos, branding and layout, is owned by 123 Building or its licensors and is protected by US and international copyright and trademark law. You may not reproduce, distribute or create derivative works from the site without our prior written permission, except for ordinary personal browsing and printing of pages for your own non-commercial reference.
8. Third-party links
We may link to third-party websites and services (for example, mapping providers and the Loopstone wholesale network at loopstone.net). We do not control these third parties and are not responsible for their content, products or practices. Your use of those sites is subject to their own terms.
9. Disclaimers
The site is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free from harmful components.

To the maximum extent permitted by law, 123 Building, its owners, officers, employees and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising from your use of the site, our store, or any merchandise purchased.
11. Governing law & venue
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any disputes will be resolved exclusively in the state or federal courts located in Queens County, New York, and you consent to personal jurisdiction there.
Dispute Resolution; Binding Arbitration; Class Action & Jury Trial Waiver
Informal Resolution
Before initiating any claim, you agree to first contact us and attempt to resolve the dispute informally. Most concerns can be resolved this way.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, this website, or our services that cannot be resolved informally shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. The arbitration shall take place in the county and state in which the Company's principal place of business is located, unless applicable law requires otherwise.
Class Action & Jury Trial Waiver
You and the Company agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. You and the Company waive any right to a jury trial and any right to participate in a class action or class-wide arbitration.
If any portion of this section is held unenforceable, the remainder of this section shall remain in effect; however, the prohibition on class, collective, or representative proceedings is non-severable.
